Terms of Service

These Terms govern your use of Banded Cigars (the “App”), operated by Banded Cigars. By downloading or using the App, you agree to these Terms. If you don’t agree, please don’t use the App.

1. Eligibility & age

The App is intended solely for adults of legal smoking age (21 in the United States (or the legal smoking age where you live)). By using the App you confirm that you meet that age requirement. The App is not intended for, marketed to, or directed at minors.

2. What Banded Cigars is — and isn’t

Banded Cigars is a personal tool for recording and remembering cigars you have chosen to enjoy. It is a journal and collection log.

3. Your account

You access the App with Sign in with Apple. You’re responsible for keeping your device and account secure and for activity that happens under your account.

4. Your content

You keep ownership of the photos, ratings, notes, and other content you add (“Your Content”). You grant us a limited license to store, process, and display Your Content solely to operate the App for you — including syncing it across your devices and showing it to a crew when you choose to share. You’re responsible for Your Content and confirm you have the right to upload it.

5. Acceptable use

You agree not to:

• Use the App for any unlawful purpose, or to violate any law.
• Use the App to advertise, market, sell, or arrange the sale or supply of tobacco or any other product.
• Upload content that is illegal, infringing, harmful, or that you don’t have the right to share.
• Harass, abuse, or harm other users in crews.
• Reverse engineer, scrape, overload, or interfere with the App or its infrastructure.

6. Identification is a best guess

The App uses automated identification to suggest what a cigar is. These results are estimates and may be incomplete or wrong. They are provided for personal, informational use only and are not authoritative.

7. Subscriptions

The core of Banded Cigars — scanning and keeping your Collection — is free. We may offer an optional paid membership that unlocks additional features. If you purchase a subscription, it is billed through your Apple App Store or Google Play account, renews automatically until canceled, and can be managed or canceled in your app store account settings. Prices and features may change with reasonable notice; payments are handled by the app stores under their terms.

8. Intellectual property

The App, its name, design, and content (other than Your Content) belong to Banded Cigars and are protected by law. We grant you a personal, non-transferable, revocable license to use the App. Banded Cigars is not affiliated with, endorsed by, or sponsored by any cigar manufacturer or brand; band names and marks belong to their respective owners and are used only to help you identify and catalog what you’ve enjoyed.

9. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of identification.

10. Limitation of liability

To the fullest extent permitted by law, Banded Cigars will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Banded Cigars from claims arising out of Your Content or your misuse of the App or violation of these Terms.

12. Termination

You can stop using the App and delete your account at any time. We may suspend or end access if you violate these Terms or use the App in a way that risks harm to others or to the service.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Effective” date above. Continued use of the App after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of [your country / state], without regard to conflict-of-laws rules.
